SAQ Performance Inc.

Waiver, Release and Hold Harmless Agreement

I, the undersigned, acknowledge that I am voluntarily participating in physical training activities with SAQ Performance Inc. that involve certain risks and that injuries, death, illness, Covid-19, property damage or other harm could occur to me or others which might result not only from my action, but also from the action, inaction, or negligence of others, through rules of play or the condition of the premises, or any equipment used and further that there may be risks not known to me or not reasonably foreseeable. I agree that prior to participating in any activity associated with SAQ Performance Inc., I will inspect the competition or practice area and all equipment to be used, and if I determine that anything related to that activity is unsafe, I will immediately advise my coach or an organizational official of this unsafe condition and will not participate until this condition is corrected.

I accept and voluntarily incur all risks of any injuries, illness, damages, or harm which arise during or result from my participation in the activity, regardless of whether or not caused in whole or in part by the negligence or other fault of SAQ Performance Inc. and or its employees or insurers (Released Parties). I waive all claims against and agree to indemnify and hold SAQ Performance Inc. and the Released Parties harmless from all injuries, illness, losses, liabilities, damages, costs or expenses, whether known or unknown, (including but not limited to reasonable attorney's fees and other litigation costs and expenses) incurred by any of the Released Parties as a result of any claims or suits that I (or anyone claiming by, under through me) may bring against any of the Released Parties to recover any losses, liabilities, costs, damages, or expenses which arise during or result from my participation in the activity, regardless of whether or not caused in whole or in part by the negligence or other fault of the Released Parties. I release and forever discharge SAQ Performance Inc. and the Released Parties from all such claims.

I have carefully read and reviewed this waiver, release and Hold Harmless Agreement. I understand it fully and I execute it voluntarily and, agree to its terms on behalf of my child and myself. I understand that by signing below I am giving up substantial rights on behalf of my child and myself.

I acknowledge that there is a no refund policy in place for these programs. I acknowledge that SAQ Performance Inc. will not be responsible for lost or stolen property.
